Background Records Check Questions and Answers
Resolved Question: Do I have a criminal record without knowing?
A couple of years ago I was very foolish and made a stupid mistake. I was over 18 years old and was supposed to have charges pressed against me. Time passed and I never got a court summons or any type of notification for any accusations. Now I finally got my act together, graduated college and I am being considered for an amazing job. They offered me the position but it will be official after I pass a background check. Can I actually have a criminal record if I never been notified, arrested or convicted of anything? Thank you for your answers.

Long story short. I got a restraining order against an ex. He beat me up with and without the order on him so he has been in trouble for that. He is in jail as of now due to a 4th degree misdemeanor.... I understand what it is. But I'm wondering what this charge on your permanent record restricts you from doing or do you loose privileges or anything? and do potential employers see this when they do background checks?? I have been searching for it and am either overlooking or cant find it! PLEASE HELP!!!! thank you so much
moreOpen Question: I was arrested when I was 19. Is there anyway to get this off my record permanently?
I am in my mid 30s now, and I got arrested for something dumb when I was in my late teens. I am finding that whenever I apply for a federal job, it is coming back to haunt me. Nowhere on the application am I omitting information, but with one job I was asked to explain myself. I was concerned about getting "singled out" from other jobs that might not have the courtesy to send a note.
Here's the thing, when I went to court, it was thrown out. I was never convicted. I never did community service, etc.. A few years back I paid to have it expunged, but that didn't seem to do anything because it was still coming back on a background check. Is there anything I can do at this point?
moreResolved Question: If an arrest is not a conviction, and employers aren't allowed to ask about arrest records, only convictions,?
then why does my arrest(that wasn't a conviction) still show up on my background check, and why do employers weigh that information when reviewing my resume?
moreOpen Question: I was detained, but never charged or convicted of a DUI - how can I get it expunged from my record?
I was in the Air Force and was detained and questioned about my involvement in a DUI. I was never convicted and never received any kind of punishment - no LOC, LOR, Art. 15, etc.
I'm trying to get into a nursing program that requires a FBI background check. On my record it shows that I was "arrested or received" by Airf Force Security Forces for a DUI. The school prefers I have a clean record.
What are the steps to getting this removed? Can you expunge an arrest/detention even if you were never convicted? Please keep in mind that this is a federal crime since it went through the Air Force and not a state agency.
moreOpen Question: Is shoplifting on my record?
I got caught shoplifting at Forever 21 when I was 16. I took less than $10 worth of stuff from their store, but they discovered about $200-300 worth of stuff from other stores in my bag. They didn't call the police, they just held me there until my parents picked me up. They took a picture of my dad's liscense. I also had to pay a $500 fine to their company later on, which I fully deserved anyway...
So will this show up on my record? Say if I apply for employment at another retail store, and they do a background check on me, will this show up?
moreOpen Question: Can I even get into nursing school for getting a misdemeanor as a minor?
I was stupid when I was 16 and stole from a military base. I feel awful for stealing and being dishonest and now I have to pay for it. Should I even attempt to be a nurse? I know the BON will do a background check and will come across this even though I wasn't technically convicted of a crime.
But my case can be risky to the medical field (that's how they will see it). I have volunteered and stayed out of trouble since, but I doubt that they will care as long as they see this.
I'm not sure if i was arrested or detained, nonetheless, i can't get around the background check or getting this found out about.
I do not want to have student loans for years to find out that I had chosen an unrealistic career path.
I currently have a 3.4 GPA in University, so I know I am capable of going to school, but being accepted into a nursing program may be impossible. I hear its hard to get in one with just a clean record. and I want to continue to go to graduate school and get a Master's degree in nursing, but all of my friends tell me it will be impossible.
Any nurses out there able to help me? or tell me if misdemeanors/theft will get in the way of pursuing a nursing career??
Thank you.
moreOpen Question: Background check for F-1 students?
Hi,
I'm an international student (under 21 years old) studying in the New York State on an F-1 visa.
I was caught shoplifting (food about $17), got my finger printed and photos taken at the police station, and got an appearance ticket to show up in the court in a month.
Anyone knows what impact this would have on my background check or record? If anything, would this incident stay on my record in the U.S. only, or would be go with me everywhere?
For example, if I were to study in Australia next year, would this incident have any negative impact on my visa and job-seeking in Australia?
Does anyone know how to wipe this off my record permanently, or at least minimize its effect?
I'm really freaked out. Any advice would be greatly appreciated!!!

moreOpen Question: What do school background checks entail?
I was arrested for domestic violence 4 years ago. My case was dismissed, therefore, no conviction. When I applied for an apartment, my DV came up and didn't show as dismissed. I contacted an attorney who said they likely pulled my arrest record and he could have it expunged (destroyed) for $400. He said my court records will be available for anyone so it wouldn't be necessary to seal those. Does this sound right? I also want to volunteer at my child's school but what do they check for? If I have my arrest record expunged will this dismissed DV show if they check court records? What about background checks for employment? Ugh!!

This song is out the film `Clockwork Orange`
It's the song they play in the background during the scene where Alex is walking around in the record shop in his long red overcoat and meets the two teenage girls looking through records. It's made with a synthesizer and around the time Alex asks the man behind the counter to check and see if something he ordered had come in yet.

I have read about it and I guess if you receive an MIP but offer to take the deversion program you can get it removed off your record. I am worried because it says for the nursing program I cannot have any misdemeanors...Ball State University...but do you think I will be okay since it was dismissed?

I can't find it anywhere, at least no places that I can find.

It's made with a synthesizer and around the time Alex asks the man behind the counter to check and see if something he ordered had come in yet.
Please I looked through every song on the movie soundtrack and searched them, none of them matched. The fact that I can't find this is driving me nuts!
*Around the time Alex asks the man about an order a woman begins to sing. It has a hollow effect that masks the words so I can't search lyrically. If anyone has the movie, the lyrics might come up with subtitles.
I think this song was made by Wendy Carlos but I can't be sure.
I listened to a 30 second track of the song you mentioned and it sounds a bit like that score, but it's not the same. The tempo isn't the same. Thank you for trying though! I really appreciate it!

I am trying to help a good friend out. He was under the First Offenders Act and it was sealed/judge signed in April 2009. The new company he went to work for did a background check on him and the record appeared. So he went to the court house and got a copy of the discharge and took it to his employer the same day. Come to find out, the courts never got the paperwork to The GBI. His employer confirmed that the record is indeed sealed but would not rehire him. On the discharge paperwork/order from the courts, it states that no employer can discriminate/refuse to employ because of it. Can he sue his employer?

My mother was attacked at work by a co worker who was just told she was fired and thought my mom has something to do with it. This hostile coworker has been harassing my mother for months. Some occassions the lady has just blatantly cursed my mom out and nothing happened to her. My mom put in her two weeks notice. it was then that the manager said he would fire the other lady. Well the morning of the attack, the lady came up and their manager informed her she was fired. She began cursing my mom but my mom walked away. The lady jumped her from behind and hit her repeatedly in the head with a coffee cup. the ambulance and police were called the lady went to jail. And after watching the tapes, the lady was coming back at my mom with a knife but someone stopped her. It was then the manager says oh yeah she carries it all the time. I would like to know if my mom can sue the lady and the company for allowing the workplace to be an unsafe environment? It was also discovered that the lady has a lenghty record which would have disqualified her fromt he job, so I'm thinking they didn't even do a background check. I DEP'd into the Navy the beginning of May as an AEF. I hadn't taken my DLAB yet, and so couldn't sign in as the CTI rating that I actually wanted. Two weeks later, I took my DLAB and passed it with a 132, and my recruiters already had an approved DAR form ready and faxed it to wherever things like that go, that afternoon. A week or so later, they had me sign a police background check form, a couple more weeks later, there was some other records release form I signed, and then nothing... They just told me today that they still haven't heard anything new yet, so all in all this process has taken 6 weeks so far.
Is this unusual? How much longer should I wait before raising a stink or making my own phone calls?

I have passed my first and second round of interviews. All the interviewers like me. They told me that they going to initiate a background check on me, and they said it's a good sign of an offer soon (no conditional/verbal offer yet).
The verification process involves employment history which my former employer found out and terminated me. A contractor called a few days later asking me to proof my internship experience, I said it's unpaid and they said I'm all set.
Another contractor for background investigation also asked me to provide some information about myself which I did. (I have no felony/criminal record)
My credit monitoring service shows that a company pulled my credit report. (I have no negative reports except one record from few years ago - medical bills that was past due bcuz they couldn't reach me after I moved out from the dorm, but I paid them off at the end)
Will I get a job soon? Or will they run the some checks on multiple candidates that they like and see who has the best record? :( I've already lost my job because of this and I don't want to be jobless.
Thanks.

I was arrested when I was 17, and I had my record cleared when I was 18 so no jobs could see my background/arrest. I can not remember if they took my fingerprints at the Youth Center I stayed at. I remember a mugshot, so I probably had fingerprints done as well. When my record is cleared, does that mean my fingerprints are cleared too? I worked for startek for 3 yrs They employ agents for AT & T mobility.I was a stellar employee, was kind to my customers, protected their privacy, gave credit when they called and asked and gave them great discounts of phones.I took great care to explain their bills to them and correct the many errors made by agents who didn't give a dam yet I along with other employees got fired in VA When we came to work at Startek we signed for a criminal background check. Then all of a sudden AT & T decided they would not employee felons and people with violent misdemeanors.I am a mother of 5 and had a resist arrest mis 11 yrs ago. They fired me and about 100 others. The majority were good agents who cared about their customers. They did this in colorado and oklahoma also because they knew they could cause this states are not right to work states.Employees do not have access to your complete soc sec number and certainly not your pin number on your debit or credit card.Yet they did not fire drug abuser mis and I can attest that many there are just plain ghetto, can't speak proper english and aren't even high school graduates and some who just don't give a damn.I have heard agents and some supervisors talk to customers like dogs and I felt sorry for the customer. At & T doesn't care about doing drug test and the druggies are still there high as ever and getting away with it.I noticed that since startek opened their 1000 agent center in the Philippines our call volume dropped.I worked at night with a skeleton crew, the systems were down most of the night and we would have 50 calls waiting. We were told we better not tell customer the systems were down but that they are updating which was a blatant lie.Agents in the stores consistently added features to customers accounts that they didn't ask for..
Who would you rather have taking care of you someone with my record or a person who committed a crime 20 yrs ago and who has proved their worth to the company or a high agent who could care less.AT and T does not care. Our county is severely economically depressed and there are not jobs.No wonder prisons have revolving doors.People do the crime and do the time. Why is AT and
T continuing to punish these folks who have rehabilitated.Surely after a yr you know what kind of an employee you have hired. These people are pitiful.AT and T is cruel and heartless. They say the customer rules but when we give too many credits we get wrote up and punished. No customer should have to wait on the line for 20 min then get a smart mouthed agent.I encourage you to report any agent who is mean to you and doesn't give you the respect you deserve.I am sorry I can't serve you any more but I guess I am a worthless piece of crap who can't be trusted simply because 11 yrs ago I refused to go with an officer.Mind you now if I had been violent I would have been charged with assault and battery of an officer but i wasn't .And the sad thing is there is nothing we can do.AT and T should have grandfathered us in if we had proved ourselves. What is your hones opinion. This is very hurtful and I gave this job my 100% and so did the others

They hired us all knowing our backgrounds. You are right they can pay the philipinos 2 per hour we have them on the sick line and you can't understand a word they say.If startek was a company with integrity it would have told at andt these are good employees and have proved themselves and should be grandfathered. before the so called new policy.
moreVoting Question: Employee Background Checks for Minors?
I own a business that mostly deals with employees who are over the age of 18, but recently we hired a few high-school aged workers. We have a company policy to do background checks on all employees, but I haven't been able to do so on workers under the age of 18. I haven't been able to find a website that has records for minors.
Does anyone know a website or other information that would allow me to do these background checks?
Thanks.
